California Employer Dismissed from Class Action PAGA Wage and Hour Suit

An employment law firm filed class-action suit on behalf of a scores of employees alleging wage and hour violations under the Private Attorneys General Act under Labor Code section 2698 et seq. (“PAGA”), which allows employees to sue on behalf of themselves and other similarly situated employees. Trepanier Tajima LLP extricated an employer from this erroneous class action suit by persuading the law firm with undeniable evidence that they had sued the wrong company with a very similar sounding name. We obtained a dismissal from the case without having to go through costly litigation and motion practice to prove the client’s complete lack of liability in the case. Without an early dismissal, the client could have been stuck in complex class action litigation for a very long time.
